    第40/2002號行政長官公告

    鑑於中華人民共和國已於一九九九年十二月十日通知作為一九六一年十月五日於海牙簽署的《關於取消外國公文認證要求的公約》保管實體之荷蘭王國,有關公約將繼續在澳門特別行政區適用。

    行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定,命令公佈中華人民共和國作出的有關通知書。該通知書的中文本、與送交保管實體的文本相符的英文本,以及有關的葡文譯本附同於本公告。

    “(…)根據一九八七年四月十三日簽署的《中華人民共和國政府和葡萄牙共和國政府關於澳門問題的聯合聲明》(以下簡稱 《聯合聲明》),中華人民共和國政府將於一九九九年十二月二十日對澳門恢復行使主權。自該日起,澳門將成為中華人民共和國的一個特別行政區,除外交和國防事務屬中華人民共和國中央人民政府管理外,享有高度自治權。

    《聯合聲明》附件一《中華人民共和國政府對澳門的基本政策的具體說明》第八節和中華人民共和國全國人民代表大會於一九九三年三月三十一日通過的《中華人民共和國澳門特別行政區基本法》(以下簡稱基本法)第一百三十八條均規定,中華人民共和國尚未參加但已適用於澳門的國際協議仍可繼續適用。

    根據上述規定,我奉中華人民共和國外交部長之命通知如下:

    目前適用於澳門的一九六一年十月五日訂於海牙的《關於取消外國公文認證要求的公約》(以下簡稱“ 公約”),自一九九九年十二月二十日起將繼續適用於澳門特別行政區。同時中華人民共和國政府聲明:

    根據公約第六條的規定,指定澳門特別行政區行政長官、行政法務司司長和法務局局長為澳門特別行政區簽發公約第三條第一款所指證明書的主管當局。

    在上述範圍內,該公約當事方的國際權利和義務將由中華人民共和國政府承擔。(…)”

    Notification

    "(...) In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macau (hereinafter referred to as the Joint Declaration) signed on 13 April 1987, the Government of the People's Republic of China will resume the exercise of sovereignty over Macau with effect from 20 December 1999. Macao will from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government of the People's Republic of China.

    It is provided both in Section VIII of Elaboration by the Government of the People's Republic of China of its Basic Policies Regarding Macau, which is annex I to the Joint Declaration, and Article 138 of the Basic Law of Macau Special Administrative Region of the People's Republic of China, which was adopted on 31 March 1993 by the National People's Congress of the People's Republic of China, that international agreements to which the Government of the People's Republic of China is not yet a party but which are implemented in Macao may continue to be implemented in the Macau Special Administrative Region.

    In accordance with the provisions mentioned above, I am instructed by the Minister of Foreign Affairs of the People's Republic of China, to inform Your Excellency of the following:

    The Convention abolishing the requirement of legalisation for foreign public documents, done at the Hague on 5 October 1961 (hereinafter referred to as the Convention), which applies to Macau at present, shall continue to apply to the Macau Special Administrative Region with effect from 20 December 1999. The Government of the People's Republic of China also wishes to make the following declaration:

    In accordance with Article 6 of the Convention, it designates the Chief Executive, the Secretary for Administration and Justice, and the Director of Justice Affairs Department of the Macau Special Administrative Region as the Authorities competent to issue the certificate referred to in the first paragraph of Article 3 of the Convention in the Macau Special Administrative Region.

    Within the above ambit, the Government of the People's Republic of China will assume the responsibility for the international rights and obligations that place on a Party to the Convention. (...)"

    Notificação

    "(...) De acordo com a Declaração Conjunta do Governo da República Popular da China e do Governo da República Portuguesa sobre a Questão de Macau (de ora em diante designada por Declaração Conjunta), assinada em 13 de Abril de 1987, o Governo da República Popular da China reassumirá o exercício da soberania sobre Macau com efeito a partir de 20 de Dezembro de 1999. A partir dessa data, Macau tornar-se-á uma Região Administrativa Especial da República Popular da China e gozará de um alto grau de autonomia, excepto nos assuntos das relações externas e da defesa, que são da responsabilidade do Governo Popular Central da República Popular da China.

    Encontra-se estipulado tanto na Secção VIII do "Esclarecimento do Governo da República Popular da China sobre as Políticas Fundamentais Respeitantes a Macau", que constitui o Anexo I da Declaração Conjunta, como no artigo 138.º da Lei Básica da Região Administrativa Especial de Macau da República Popular da China, adoptada em 31 de Março de 1993 pela Assembleia Popular Nacional da República Popular da China, que os acordos internacionais de que o Governo da República Popular da China ainda não é parte, mas que são aplicados em Macau, poderão continuar a aplicar-se na Região Administrativa Especial de Macau.

    Em conformidade com os supracitados preceitos, fui instruído pelo Ministro dos Negócios Estrangeiros da República Popular da China para informar Vossa Excelência do seguinte:

    A Convenção Relativa à Supressão da Exigência da Legalização dos Actos Públicos Estrangeiros, concluída na Haia, em 5 de Outubro de 1961 (de ora em diante designada por Convenção), actualmente aplicável em Macau, continuará a aplicar-se na Região Administrativa Especial de Macau com efeito a 20 de Dezembro de 1999. O Governo da República Popular da China deseja igualmente fazer a seguinte declaração:

    Nos termos do artigo 6.º da Convenção, designa o Chefe do Executivo, o Secretário para a Administração e Justiça e o Director da Direcção dos Serviços de Assuntos de Justiça da Região Administrativa Especial de Macau como autoridades competentes para emitir na Região Administrativa Especial de Macau a apostilha a que se refere o primeiro parágrafo do artigo 3.º da Convenção.

    Neste âmbito, o Governo da República Popular da China assumirá a responsabilidade pelos direitos e obrigações internacionais de Parte da Convenção. (...)"
