    Aviso do Chefe do Executivo n.º 87/2011

    O Governo da República Portuguesa e o Governo da República Popular da China concluíram, por troca de notas, o acordo relativo ao estabelecimento do Consulado Geral da República Portuguesa na Região Administrativa Especial de Macau da República Popular da China. Neste sentido, o Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, por ordem do Governo Popular Central, a Nota do Governo da República Portuguesa no seu texto autêntico em língua portuguesa, acompanhado da respectiva tradução para as línguas chinesa e inglesa e a Nota do Governo da República Popular da China no seu texto autêntico em língua chinesa, acompanhado da respectiva tradução para a língua inglesa.

    Mais se torna público que o referido acordo entrou em vigor em 20 de Dezembro de 1999.

    Promulgado em 3 de Novembro de 2011.

    A Embaixada de Portugal em Pequim apresenta os seus cumprimentos ao Ministério dos Negócios Estrangeiros da República, Popular da China e tem a honra de propôr, em nome do Governo da República Portuguesa, em aplicação do Anexo I da Declaração Conjunta do Governo da República Portuguesa e do Governo da Republica Popular da China sobre a Questão de Macau, feita em Pequim, em 13 de Abril de 1987, nos termos do qual a República Portuguesa poderá estabelecer um Consulado-Geral na Região Administrativa Especial de Macau e, de acordo com o desejo comum de desenvolver ainda mais as relações amistosas e de fortalecer as relações consulares entre ambos os países, que os Governos da República Portuguesa e da República Popular da China acordem, por este meio, no estabelecimento de um Consulado-Geral de Portugal na Região Administrativa Especial de Macau, nos termos seguintes:

    1. O Governo da República Popular da China dá o seu acordo a que Governo da República Portuguesa possa estabelecer um Consulado-Geral em Macau cujo distrito consular compreenda a Região Administrativa Especial de Macau.

    2. O Consulado-Geral de Portugal na Região Administrativa Especial de Macau exercerá as suas funções consulares e gozará das correspondentes facilidades, privilégios e imunidades dentro dos limites da Convenção de Viena sobre Relações Consulares de 24 de Abril de 1963 e de acordo com as relevantes leis e regulamentos da República Popular da China, incluindo as leis e regulamentos da Região Administrativa Especial de Macau.

    3. As isenções de direitos e taxas que vierem a ser concedidas com relação às instalações do Consulado-Geral sê-lo-ão também com relação à residência do funcionário consular de que o Estado português ou qualquer pessoa actuando em seu nome forem proprietários ou arrendatários.

    4. O Governo da República Popular da China prestará, de acordo com a Convenção de Viena sobre Relações Consulares e as relevantes leis e regulamentos da República Popular da China, a necessária assistência e facilidades ao Consulado-Geral de Portugal na Região Administrativa Especial de Macau no exercício da suas funções consulares.

    5. As duas Partes tratarão de assuntos consulares entre si de um modo adequado, num espírito, de consulta, amigável e de acordo com a Convenção de Viena sobre Relações Consulares e a prática internacional.

    Se os pontos acima referidos forem confirmados, por meio de uma Nota do Ministério de Negócios Estrangeiros em nome do Governo da República Popular da China a presente Nota e a Nota da resposta do Ministério de Negócios Estrangeiros constituirão um Acordo entre ambos os Governos que entrará em vigor a partir de 20 de Dezembro de 1999.

    A Embaixada de Portugal em Pequim aproveita o ensejo para reiterar ao Ministério dos Negócios Estrangeiros da República Popular da China os protestos da sua mais elevada consideração.


    The Embassy of the Republic of Portugal in China presents its compliments to the Ministry of Foreign Affairs of the People’s Republic of China and would like to propose, on behalf of the Government of the Republic of Portugal, in implementation of the Annex 1 of the Joint Declaration of the Government of the Republic of Portugal, and the Government of the People’s Republic of China on the question of Macao, done at Beijing on 13th April 1987, whereby it is provided that the Republic of Portugal may establish a Consulate-General in the Macao Special Administrative Region, and proceeding from the common desire further to develop friendly relations and strengthen consular relations between the two countries, that the Governments of the Republic of Portugal, and of the People’s Republic of China hereby agree on the establishment of a Portuguese Consulate-General in the Macao Special Administrative Region as follows:

    1. The Government of the People’s Republic of China agrees that the Government of the Republic of Portugal may establish a Consulate-General in Macao with the consular district comprising the Macao Special Administrative Region.

    2. The Consulate-General of the Republic of Portugal in the Macao Special Administrative Region shall exercise its consular functions and enjoy the corresponding facilities, privileges and immunities within the limits of the Vienna convention on consular relations done on 24th April 1963 and the relevant laws and regulations of the People’s Republic of China, including the laws and regulations of the Macao Special Administrative Region.

    3. The like exemption from dues and taxes as shall be accorded to the premises of the Consulate-General shall be accorded to the residence of a consular officer of which the Government of the Republic of Portugal, or any person acting on its behalf, is the owner or lessee.

    4. The Government of the People’s Republic of China will, in accordance with the Vienna Convention on Consular relations and the relevant laws and regulations of the People’s Republic of China, provide necessary assistance and facilities to the Consulate-General of Portugal in the Macao Special Administrative Region in the exercise of its consular functions.

    5. The two sides shall properly handle consular matters Between them in the spirit of friendly consultations, and in accordance with the Vienna Convention on Consular Relations and international practice.

    If the above points are confirmed by a reply note of the Ministry of Foreign Affairs on behalf of the Government of the People’s Republic of China the present note and the reply note of the Ministry of Foreign Affairs shall form an agreement between the two Governments and shall enter into force as from 20th December 1999.

    The Embassy of the Republic of Portugal avails itself of this opportunity to renew to the Ministry of Foreign Affairs the assurances of its highest consideration.

    The Ministry of Foreign Affairs of the People’s Republic of China presents its compliments to the Embassy of the Republic of Portugal in China and has the honour to acknowledge receipt of the latter’s Note No. 266 dated 8 July 1999, which reads as follows:

    “The Embassy of the Republic of Portugal in China presents its compliments to the Ministry of Foreign Affairs of the People’s Republic of China and would like to propose, on behalf of the Government of the Republic of Portugal, in implementation of the Annex 1 of the Joint Declaration of the Government of the Republic of Portugal and the Government of the People’s Republic of China on the question of Macao, done at Beijing on 13 April 1987, whereby it is provided that the Republic of Portugal may establish a Consulate-General in the Macao Special Administrative Region, and proceeding from the common desire further to develop friendly relations and strengthen consular relations between the two countries, that the Governments of the Republic of Portugal and the People’s Republic of China hereby agree on the establishment of a Portuguese Consulate-General in the Macao Special Administrative Region as follows:
