    Considerando que a República Popular da China efectuou, em 5 de Janeiro de 2000, junto do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, o depósito do seu instrumento de adesão à Convenção para a Protecção dos Bens Culturais em Caso de Conflito Armado, feita na Haia, em 14 de Maio de 1954 (Convenção) e declarou que:

    «(…) a assinatura da Convenção (…) pelas autoridades de Taiwan, em usurpação do nome “China” é ilegal, nula e sem efeito.»;

    Considerando igualmente que em conformidade com o disposto no n.º 2 do seu artigo 33.º, a Convenção entrou em vigor para a República Popular da China em 5 de Abril de 2000, incluindo a Região Administrativa Especial de Macau;

    O Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, a Convenção no seu texto autêntico em língua inglesa, acompanhado da respectiva tradução para a língua portuguesa.

    CONVENTION FOR THE PROTECTION OF CULTURAL PROPERTY IN THE EVENT OF ARMED CONFLICT. DONE AT THE HAGUE, ON 14 MAY 1954

    The High Contracting Parties,

    Recognizing that cultural property has suffered grave damage during recent armed conflicts and that, by reason of the developments in the technique of warfare, it is in increasing danger of destruction;

    Being convinced that damage to cultural property belonging to any people whatsoever means damage to the cultural heritage of all mankind, since each people makes its contribution to the culture of the world;

    Considering that the preservation of the cultural heritage is of great importance for all peoples’ of the world and that it is important that this heritage should receive international protection;

    Guided by the principles concerning the protection of cultural property during armed conflict, as established in the Conventions of The Hague of 1899 and of 1907  and in the Washington Pact of 15 April, 1935;

    Being of the opinion that such protection cannot be effective unless both national and international measures have been taken to organize it in time of peace;

    Being determined to take all possible steps to protect cultural property;

    Have agreed upon the following provisions:

    CHAPTER I

    GENERAL PROVISIONS REGARDING PROTECTION

    Article 1

    DEFINITION OF CULTURAL PROPERTY

    For the purposes of the present Convention, the term “cultural property” shall cover, irrespective of origin or ownership:

    (a) movable or immovable property of great importance to the cultural heritage of every people, such as monuments of architecture, art or history, whether religious or secular; archaeological sites; groups of buildings which, as a whole, are of historical or artistic interest; works of art; manuscripts, books and other objects of artistic, historical or archaeological interest; as well as scientific collections and important collections of books or archives or of reproductions of the property defined above;

    (b) buildings whose main and effective purpose is to preserve or exhibit the movable cultural property defined in sub-paragraph (a) such as museums, large libraries and depositories of archives, and refuges intended to shelter, in the event of armed conflict, the movable cultural property defined in sub-paragraph (a);

    (c) centres containing a large amount of cultural property as defined in sub-paragraphs (a) and (b), to be known as “centres containing monuments”.

    Article 2

    PROTECTION OF CULTURAL PROPERTY

    For the purposes of the present Convention, the protection of cultural property shall comprise the safeguarding of and respect for such property.

    Article 3

    SAFEGUARDING OF CULTURAL PROPERTY

    The High Contracting Parties undertake to prepare in time of peace for the safeguarding of cultural property situated within their own territory against the foreseeable effects of an armed conflict, by taking such measures as they consider appropriate.

    Article 4

    RESPECT FOR CULTURAL PROPERTY

    1. The High Contracting Parties undertake to respect cultural property situated within their own territory as well as within the territory of other High Contracting Parties by refraining from any use of the property and its immediate surroundings or of the appliances in use for its protection for purposes which are likely to expose it to destruction or damage in the event of armed conflict; and by refraining from any act of hostility directed against such property.

    2. The obligations mentioned in paragraph 1 of the present Article may be waived only in cases where military necessity imperatively requires such a waiver.

    3. The High Contracting Parties further undertake to prohibit, prevent and, if necessary, put a stop to any form of theft, pillage or misappropriation of, and any acts of vandalism directed against, cultural property. They shall refrain from requisitioning movable cultural property situated in the territory of another High Contracting Party.

    4. They shall refrain from any act directed by way of reprisals against cultural property.

    5. No High Contracting Party may evade the obligations incumbent upon it under the present Article, in respect of another High Contracting Party, by reason of the fact that the latter has not applied the measures of safeguard referred to in Article 3.

    Article 5

    OCCUPATION

    1. Any High Contracting Party in occupation of the whole or part of the territory of another High Contracting Party shall as far as possible support the competent national authorities of the occupied country in safeguarding and preserving its cultural property.

    2. Should it prove necessary to take measures to preserve cultural property situated in occupied territory and damaged by military operations, and should the competent national authorities be unable to take such measures, the Occupying Power shall, as far as possible, and in close co-operation with such authorities, take the most necessary measures of preservation.

    3. Any High Contracting Party whose government is considered their legitimate government by members of a resistance movement, shall, if possible, draw their attention to the obligation to comply with those provisions of the Convention dealing with respect for cultural property.

    Article 6

    DISTINCTIVE MARKING OF CULTURAL PROPERTY

    In accordance with the provisions of Article 16, cultural property may bear a distinctive emblem so as to facilitate its recognition.

    Article 7

    MILITARY MEASURES

    1. The High Contracting Parties undertake to introduce in time of peace into their military regulations or instructions such provisions as may ensure observance of the present Convention, and to foster in the members of their armed forces a spirit of respect for the culture and cultural property of all peoples.

    2. The High Contracting Parties undertake to plan or establish in peacetime, within their armed forces, services or specialist personnel whose purpose will be to secure respect for cultural property and to co-operate with the civilian authorities responsible for safeguarding it.

    CHAPTER II

    SPECIAL PROTECTION

    Article 8

    GRANTING OF SPECIAL PROTECTION

    1. There may be placed under special protection a limited number of refuges intended to shelter movable cultural property in the event of armed conflict, of centres containing monuments and other immovable cultural property of very great importance, provided that they:

    (a) are situated at an adequate distance from any large industrial centre or from any important military objective constituting a vulnerable point, such as, for example, an aerodrome, broadcasting station, establishment engaged upon work of national defence, a port or railway station of relative importance or a main line of communication;

    (b) are not used for military purposes.

    2. A refuge for movable cultural property may also be placed under special protection, whatever its location, if it is so constructed that, in all probability, it will not be damaged by bombs.

    3. A centre containing monuments shall be deemed to be used for military purposes whenever it is used for the movement of military personnel or material, even in transit. The same shall apply whenever activities directly connected with military operations, the stationing of military personnel, or the production of war material are carried on within the centre.

    4. The guarding of cultural property mentioned in paragraph 1 above by armed custodians specially empowered to do so, or the presence, in the vicinity of such cultural property, of police forces normally responsible for the maintenance of public order shall not be deemed to be use for military purposes.

    5. If any cultural property mentioned in paragraph 1 of the present Article is situated near an important military objective as defined in the said paragraph, it may nevertheless be placed under special protection if the High Contracting Party asking for that protection undertakes, in the event of armed conflict, to make no use of the objective and particularly, in the case of a port, railway station or aerodrome, to divert all traffic therefrom. In that event, such diversion shall be prepared in time of peace.

    6. Special protection is granted to cultural property by its entry in the “International Register of Cultural Property under Special Protection”. This entry shall only be made, in accordance with the provisions of the present Convention and under the conditions provided for in the Regulations1  for the execution of the Convention.

    Article 9

    IMMUNITY OF CULTURAL PROPERTY UNDER SPECIAL PROTECTION

    The High Contracting Parties undertake to ensure the immunity of cultural property under special protection by refraining, from the time of entry in the International Register, from any act of hostility directed against such property and, except for the cases provided for in paragraph 5 of Article 8, from any use of such property or its surroundings for military purposes.

    Article 10

    IDENTIFICATION AND CONTROL

    During an armed conflict, cultural property under special protection shall be marked with the distinctive emblem described in Article 16, and shall be open to international control as provided for in the Regulations for the execution of the Convention.

    Article 11

    WITHDRAWAL OF IMMUNITY

    1. If one of the High Contracting Parties commits, in respect of any item of cultural property under special protection, a violation of the obligations under Article 9, the opposing Party shall, so long as this violation persists, he released from the obligation to ensure the immunity of the property concerned. Nevertheless, whenever possible, the latter Party shall first request the cessation of such violation within a reasonable time.

    2. Apart from the case provided for in paragraph 1 of the present Article, immunity shall be withdrawn from cultural property under special protection only in exceptional cases of unavoidable military necessity, and only for such time as that necessity continues. Such necessity can be established only by the officer commanding a force the equivalent of a division in size or larger. Whenever circumstances permit, the opposing Party shall be notified, a reasonable time in advance, of the decision to withdraw immunity.

    3. The Party withdrawing immunity shall, as soon as possible, so inform the Commissioner-General for cultural property provided for in the Regulations for the execution of the Convention, in writing, stating the reasons.

    CHAPTER III

    TRANSPORT OF CULTURAL PROPERTY

    Article 12

    TRANSPORT UNDER SPECIAL PROTECTION

    1. Transport exclusively engaged in the transfer of cultural property, whether within a territory or to another territory, may, at the request of the High Contracting Party concerned, take place under special protection in accordance with the conditions specified in the Regulations for the execution of the Convention.

    2. Transport under special protection shall take place under the international supervision provided for in the aforesaid Regulations and shall display the distinctive emblem described in Article 16.

    3. The High Contracting Parties shall refrain from any act of hostility directed against transport under special protection.

    Article 13

    TRANSPORT IN URGENT CASES

    1. If a High Contracting Party considers that the safety of certain cultural property requires its transfer and that the matter is of such urgency that the procedure laid down in Article 12 cannot be followed, especially at the beginning of an armed conflict, the transport may display the distinctive emblem described in Article 16, provided that an application for immunity referred to in Article 12 has not already been made and refused. As far as possible, notification of transfer should be made to the opposing Parties. Nevertheless, transport conveying cultural property to the territory of another country may not display the distinctive emblem unless immunity has been expressly granted to it.

    2. The High Contracting Parties shall take, so far as possible, the necessary precautions to avoid acts of hostility directed against the transport described in paragraph 1 of the present Article and displaying the distinctive emblem.

    Article 14

    IMMUNITY FROM SEIZURE, CAPTURE AND PRIZE

    1. Immunity from seizure, placing in prize, or capture shall be granted to:

    (a) cultural property enjoying the protection provided for in Article 12 or that provided for in Article 13;

    (b) the means of transport exclusively engaged in the transfer of such cultural property.

    2. Nothing in the present Article shall limit the right of visit and search.

    CHAPTER IV

    PERSONNEL

    Article 15

    PERSONNEL

    As far as is consistent with the interests of security, personnel engaged in the protection of cultural property shall, in the interests of such property, be respected and, if they fall into the hands of the opposing Party, shall be allowed to continue to carry out their duties whenever the cultural property for which they are responsible has also fallen into the hands of the opposing Party.

    CHAPTER V

    THE DISTINCTIVE EMBLEM

    Article 16

    EMBLEM OF THE CONVENTION

    1. The distinctive emblem of the Convention shall take the form of a shield, pointed below, per saltire blue and white (a shield consisting of a royal-blue square, one of the angles of which forms the point of the shield, and of a royal-blue triangle above the square, the space on either side being taken up by a white triangle).

    2. The emblem shall be used alone, or repeated three times in a triangular formation (one shield below), under the conditions provided for in Article 17.

    Article 17

    USE OF THE EMBLEM

    1. The distinctive emblem repeated three times may be used only as a means of identification of:

    (a) immovable cultural property under special protection;

    (b) the transport of cultural property under the conditions provided for in Articles 12 and 13;

    (c) improvised refuges, under the conditions provided for in the Regulations for the execution of the Convention.

    2. The distinctive emblem may be used alone only as a means of identification of:

    (a) cultural property not under special protection;

    (b) the persons responsible for the duties of control in accordance with the Regulations for the execution of the Convention;

    (c) the personnel engaged in the protection of cultural property;

    (d) the identity cards mentioned in the Regulations for the execution of the Convention.

    3. During an armed conflict, the use of the distinctive emblem in any other cases than those mentioned in the preceding paragraphs of the present Article, and the use for any purpose whatever of a sign resembling the distinctive emblem, shall be forbidden.

    4. The distinctive emblem may not be placed on any immovable cultural property unless at the same time there is displayed an authorization duly dated and signed by the competent authority of the High Contracting Party.

    CHAPTER VI

    SCOPE OF APPLICATION OF THE CONVENTION

    Article 18

    APPLICATION OF THE CONVENTION

    1. Apart from the provisions which shall take effect in time of peace, the present Convention shall apply in the event of declared war or of any other armed conflict which may arise between two or more of the High Contracting Parties, even if the state of war is not recognized by one or more of them.

    2. The Convention shall also apply to all cases of partial or total occupation of the territory of a High Contracting Party, even if the said occupation meets with no armed resistance.

    3. If one of the Powers in conflict is not a Party to the present Convention, the Powers which are Parties thereto shall nevertheless remain bound by it in their mutual relations. They shall furthermore be bound by the Convention, in relation to the said Power, if the latter has declared that it accepts the provisions thereof and so long as it applies them.

    Article 19

    CONFLICTS NOT OF AN INTERNATIONAL CHARACTER

    1. In the event of an armed conflict not of an international character occurring within the territory of one of the High Contracting Parties, each party to the conflict shall be bound to apply, as a minimum, the provisions of the present Convention which relate to respect for cultural property.

    2. The parties to the conflict shall endeavour to bring into force, by means of special agreements, all or part of the other provisions of the present Convention.

    3. The United Nations Educational, Scientific and Cultural Organization may offer its services to the parties to the conflict.

    4. The application of the preceding provisions shall not affect the legal status of the parties to the conflict.

    CHAPTER VII

    EXECUTION OF THE CONVENTION

    Article 20

    REGULATIONS FOR THE EXECUTION OF THE CONVENTION

    The procedure by which the present Convention is to be applied is defined in the Regulations for its execution, which constitute an integral part thereof.

    Article 21

    PROTECTING POWERS

    The present Convention and the Regulations for its execution shall be applied with the co-operation of the Protecting Powers responsible for safeguarding the interests of the Parties to the conflict.

    Article 22

    CONCILIATION PROCEDURE

    1. The Protecting Powers shall lend their good offices in all cases where they may deem it useful in the interests of cultural property, particularly if there is disagreement between the Parties to the conflict as to the application or interpretation of the provisions of the present Convention or the Regulations for its execution.

    2. For this purpose, each of the Protecting Powers may, either at the invitation of one Party, of the Director-General of the United Nations Educational, Scientific and Cultural Organization, or on its own initiative, propose to the Parties to the conflict a meeting of their representatives, and in particular of the authorities responsible for the protection of cultural property, if considered appropriate on suitably chosen neutral territory. The Parties to the conflict shall be bound to give effect to the proposals for meeting made to them. The Protecting Powers shall propose for approval by the Parties to the conflict a person belonging to a neutral Power or a person presented by the Director-General of the United Nations Educational, Scientific and Cultural Organization, which person shall be invited to take part in such a meeting in the capacity of Chairman.

    Article 23

    ASSISTANCE OF UNESCO

    1. The High Contracting Parties may call upon the United Nations Educational, Scientific and Cultural Organization for technical assistance in organizing the protection of their cultural property, or in connexion with any other problem arising out of the application of the present Convention or the Regulations for its execution. The Organization shall accord such assistance within the limits fixed by its programme and by its resources.

    2. The Organization is authorized to make, on its own initiative, proposals on this matter to the High Contracting Parties.

    Article 24

    SPECIAL AGREEMENTS

    1. The High Contracting Parties may conclude special agreements for all matters concerning which they deem it suitable to make separate provision.

    2. No special agreement may be concluded which would diminish the protection afforded by the present Convention to cultural property and to the personnel engaged in its protection.

    Article 25

    DISSEMINATION OF THE CONVENTION

    The High Contracting Parties undertake, in time of peace as in time of armed conflict, to disseminate the text of the present Convention and the Regulations for its execution as widely as possible in their respective countries. They undertake, in particular, to include the study thereof in their programmes of military and, if possible, civilian training, so that its principles are made known to the whole population, especially the armed forces and personnel engaged in the protection of cultural property.

    Article 26

    TRANSLATIONS, REPORTS

    1. The High Contracting Parties shall communicate to one another, through the Director-General of the United Nations Educational, Scientific and Cultural Organization, the official translations of the present Convention and of the Regulations for its execution.

    2. Furthermore, at least once every four years, they shall forward to the Director-General a report giving whatever information they think suitable concerning any measures being taken, prepared or contemplated by their respective administrations in fulfilment of the present Convention and of the Regulations for its execution.

    Article 27

    MEETINGS

    1. The Director-General of the United Nations Educational, Scientific and Cultural Organization may, with the approval of the Executive Board, convene meetings of representatives of the High Contracting Parties. He must convene such a meeting if at least one-fifth of the High Contracting Parties so request.

    2. Without prejudice to any other functions which have been conferred on it by the present Convention or the Regulations for its execution, the purpose of the meeting will be to study problems concerning the application of the Convention and of the Regulations for its execution, and to formulate recommendations in respect thereof.

    3. The meeting may further undertake a revision of the Convention or the Regulations for its execution if the majority of the High Contracting Parties are represented, and in accordance with the provisions of Article 39.

    Article 28

    SANCTIONS

    The High Contracting Parties undertake to take, within the framework of their ordinary criminal jurisdiction, all necessary steps to prosecute and impose penal or disciplinary sanctions upon those persons, of whatever nationality, who commit or order to be committed a breach of the present Convention.

    FINAL PROVISIONS

    Article 29

    LANGUAGES

    1. The present Convention is drawn up in English, French, Russian and Spanish, the four texts being equally authoritative.

    2. The United Nations Educational, Scientific and Cultural Organization shall arrange for translations of the Convention into the other official languages of its General Conference.

    Article 30

    SIGNATURE

    The present Convention shall bear the date of 14 May, 1954 and, until the date of 31 December, 1954, shall remain open for signature by all States invited to the Conference which met at The Hague from 21 April, 1954 to 14 May, 1954.

    Article 31

    RATIFICATION

    1. The present Convention shall be subject to ratification by signatory States in accordance with their respective constitutional procedures.

    2. The instruments of ratification shall be deposited with the Director-General of the United Nations Educational, Scientific and Cultural Organization.

    Article 32

    ACCESSION

    From the date of its entry into force, the present Convention shall be open for accession by all States mentioned in Article 30 which have not signed it, as well as any other State invited to accede by the Executive Board of the United Nations Educational, Scientific and Cultural Organization. Accession shall be effected by the deposit of an instrument of accession with the Director-General of the United Nations Educational, Scientific and Cultural Organization.

    Article 33

    ENTRY INTO FORCE

    1. The present Convention shall enter into force three months after five instruments of ratification have been deposited.

    2. Thereafter, it shall enter into force, for each High Contracting Party, three months after the deposit of its instrument of ratification or accession.

    3. The situations referred to in Articles 18 and 19 shall give immediate effect to ratifications or accessions deposited by the Parties to the conflict either before or after the beginning of hostilities or occupation. In such cases the Director-General of the United Nations Educational, Scientific and Cultural Organization shall transmit the communications referred to in Article 38 by the speediest method.

    Article 34

    EFFECTIVE APPLICATION

    1. Each State Party to the Convention on the date of its entry into force shall take all necessary measures to ensure its effective application within a period of six months after such entry into force.

    2. This period shall be six months from the date of deposit of the instruments of ratification or accession for any State which deposits its instrument of ratification or accession after the date of the entry into force of the Convention.

    Article 35

    TERRITORIAL EXTENSION OF THE CONVENTION

    Any High Contracting Party may, at the time of ratification or accession, or at any time thereafter, declare by notification addressed to the Director-General of the United Nations Educational, Scientific and Cultural Organization, that the present Convention shall extend to all or any of the territories for whose international relations it is responsible. The said notification shall take effect three months after the date of its receipt.

    Article 36

    RELATION TO PREVIOUS CONVENTIONS

    1. In the relations between Powers which are bound by the Conventions of The Hague concerning the Laws and Customs of War on Land (IV) and concerning Naval Bombardment in Time of War (IX), whether those of 29 July, 1899 or those of 18 October, 1907, and which are Parties to the present Convention, this last Convention shall be supplementary to the aforementioned Convention (IX) and to the Regulations annexed to the aforementioned Convention (IV) and shall substitute for the emblem described in Article 5 of the aforementioned Convention (IX) the emblem described in Article 16 of the present Convention, in cases in which the present Convention and the Regulations for its execution provide for the use of this distinctive emblem.

    2. In the relations between Powers which are bound by the Washington Pact of 15 April, 1935 for the Protection of Artistic and Scientific Institutions and of Historic Monuments (Roerich Pact) and which are Parties to the present Convention, the latter Convention shall be supplementary to the Roerich Pact and shall substitute for the distinguishing flag described in Article III of the Pact the emblem defined in Article 16 of the present Convention, in cases in which the present Convention and the Regulations for its execution provide for the use of this distinctive emblem.

    Article 37

    DENUNCIATION

    1. Each High Contracting Party may denounce the present Convention, on its own behalf, or on behalf of any territory for whose international relations it is responsible.

    2. The denunciation shall be notified by an instrument in writing, deposited with the Director-General of the United Nations Educational, Scientific and Cultural Organization.

    3. The denunciation shall take effect one year after the receipt of the instrument of denunciation. However, if, on the expiry of this period, the denouncing Party is involved in an armed conflict, the denunciation shall not take effect until the end of hostilities, or until the operations of repatriating cultural property are completed, whichever is the later.

    Article 38

    NOTIFICATIONS

    The Director-General of the United Nations Educational, Scientific and Cultural Organization shall inform the States referred to in Articles 30 and 32, as well as the United Nations, of the deposit of all the instruments of ratification, accession or acceptance provided for in Articles 31, 32 and 39 and of the notifications and denunciations provided for respectively in Articles 35, 37 and 39.

    Article 39

    REVISION OF THE CONVENTION AND OF THE REGULATIONS FOR ITS EXECUTION

    1. Any High Contracting Party may propose amendments to the present Convention or the Regulations for its execution. The text of any proposed amendment shall be communicated to the Director-General of the United Nations Educational, Scientific and Cultural Organization who shall transmit it to each High Contracting Party with the request that such Party reply within four months stating whether it:

    (a) desires that a Conference be convened to consider the proposed amendment;

    (b) favours the acceptance of the proposed amendment without a Conference; or

    (c) favours the rejection of the proposed amendment without a Conference.

    2. The Director-General shall transmit the replies, received under paragraph 1 of the present Article, to all High Contracting Parties.

    3. If all the High Contracting Parties which have, within the prescribed time-limit, stated their views to the Director-General of the United Nations Educational, Scientific and Cultural Organization, pursuant to paragraph 1 (b) of this Article, inform him that they favour acceptance of the amendment without a Conference, notification of their decision shall be made by the Director-General in accordance with Article 38. The amendment shall become effective for all the High Contracting Parties on the expiry of ninety days from the date of such notification.

    4. The Director-General shall convene a Conference of the High Contracting Parties to consider the proposed amendment if requested to do so by more than one-third of the High Contracting Parties.

    5. Amendments to the Convention or to the Regulations for its execution, dealt with under the provisions of the preceding paragraph, shall enter into force only after they have been unanimously adopted by the High Contracting Parties represented at the Conference and accepted by each of the High Contracting Parties.

    6. Acceptance by the High Contracting Parties of amendments to the Convention or to the Regulations for its execution, which have been adopted by the Conference mentioned in paragraphs 4 and 5, shall be effected by the deposit of a formal instrument with the Director-General of the United Nations Educational, Scientific and Cultural Organization.

    7. After the entry into force of amendments to the present Convention or to the Regulations for its execution, only the text of the Convention or of the Regulations for its execution thus amended shall remain open for ratification or accession.

    Article 40

    REGISTRATION

    In accordance with Article 102 of the Charter of the United Nations, the present Convention shall be registered with the Secretariat of the United Nations at the request of the Director-General of the United Nations Educational, Scientific and Cultural Organization.

    IN FAITH WHEREOF the undersigned, duly authorized, have signed the present Convention.

    DONE at The Hague, this fourteenth day of May, 1954, in a single copy which shall be deposited in the archives of the United Nations Educational, Scientific and Cultural Organization, and certified true copies of which shall be delivered to all the States referred to in Articles 30 and 32 as well as to the United Nations.

    REGULATIONS FOR THE EXECUTION OF THE CONVENTION FOR THE PROTECTION OF CULTURAL PROPERTY IN THE EVENT OF ARMED CONFLICT

    CHAPTER I

    CONTROL

    Article 1

    INTERNATIONAL LIST OF PERSONS

    On the entry into force of the Convention, the Director-General of the United Nations Educational, Scientific and Cultural Organization shall compile an international list consisting of all persons nominated by the High Contracting Parties as qualified to carry out the functions of Commissioner-General for Cultural Property. On the initiative of the Director-General of the United Nations Educational, Scientific and Cultural Organization, this list shall be periodically revised on the basis of requests formulated by the High Contracting Parties.

    Article 2

    ORGANIZATION OF CONTROL

    As soon as any High Contracting Party is engaged in an armed conflict to which Article 18 of the Convention applies:

    (a) It shall appoint a representative for cultural property situated in its territory; if it is in occupation of another territory, it shall appoint a special representative for cultural property situated in that territory;

    (b) The Protecting Power acting for each of the Parties in conflict with such High Contracting Party shall appoint delegates accredited to the latter in conformity with Article 3 below;

    (c) A Commissioner-General for Cultural Property shall be appointed to such High Contracting Party in accordance with Article 4.

    Article 3

    APPOINTMENT OF DELEGATES OF PROTECTING POWERS

    The Protecting Power shall appoint its delegates from among the members of its diplomatic or consular staff or, with the approval of the Party to which they will be accredited, from among other persons.

    Article 4

    APPOINTMENT OF COMMISSIONER-GENERAL

    1. The Commissioner-General for Cultural Property shall be chosen from the international list of persons by joint agreement between the Party to which he will be accredited and the Protecting Powers acting on behalf of the opposing Parties.

    2. Should the Parties fail to reach agreement within three weeks from the beginning of their discussions on this point, they shall request the President of the International Court of Justice to appoint the Commissioner-General, who shall not take up his duties until the Party to which he is accredited has approved his appointment.

    Article 5

    FUNCTIONS OF DELEGATES

    The delegates of the Protecting Powers shall take note of violations of the Convention, investigate, with the approval of the Party to which they are accredited, the circumstances in which they have occurred, make representations locally to secure their cessation and, if necessary, notify the Commissioner-General of such violations. They shall keep him informed of their activities.

    Article 6

    FUNCTIONS OF THE COMMISSIONER-GENERAL

    1. The Commissioner-General for Cultural Property shall deal with all matters referred to him in connexion with the application of the Convention, in conjunction with the representative of the Party to which he is accredited and with the delegates concerned.

    2. He shall have powers of decision and appointment in the cases specified in the present Regulations.

    3. With the agreement of the Party to which he is accredited, he shall have the right to order an investigation or to conduct it himself.

    4. He shall make any representations to the Parties to the conflict or to their Protecting Powers which he deems useful for the application of the Convention.

    5. He shall draw up such reports as may be necessary on the application of the Convention and communicate them to the Parties concerned and to their Protecting Powers. He shall send copies to the Director-General of the United Nations Educational, Scientific and Cultural Organization, who may make use only of their technical contents.

    6. If there is no Protecting Power, the Commissioner-General shall exercise the functions of the Protecting Power as laid down in Articles 21 and 22 of the Convention.

    Article 7

    INSPECTORS AND EXPERTS

    1. Whenever the Commissioner-General for Cultural Property considers it necessary, either at the request of the delegates concerned or after consultation with them, he shall propose, for the approval of the Party to which he is accredited, an inspector of cultural property to be charged with a specific mission. An inspector shall be responsible only to the Commissioner-General.

    2. The Commissioner-General, delegates and inspectors may have recourse to the services of experts, who will also be proposed for the approval of the Party mentioned in the preceding paragraph.

    Article 8

    DISCHARGE OF THE MISSION OF CONTROL

    The Commissioners-General for Cultural Property, delegates of the Protecting Powers, inspectors and experts shall in no case exceed their mandates. In particular, they shall take account of the security needs of the High Contracting Party to which they are accredited and shall in all circumstances act in accordance with the requirements of the military situation as communicated to them by that High Contracting Party.

    Article 9

    SUBSTITUTES FOR PROTECTING POWERS

    If a Party to the conflict does not benefit or ceases to benefit from the activities of a Protecting Power, a neutral State may be asked to undertake those functions of a Protecting Power which concern the appointment of a Commissioner-General for Cultural Property in accordance with the procedure laid down in Article 4 above. The Commissioner-General thus appointed shall, if need be, entrust to inspectors the functions of delegates of Protecting Powers as specified in the present Regulations.

    Article 10

    EXPENSES

    The remuneration and expenses of the Commissioner-General for Cultural Property, inspectors and experts shall be met by the Party to which they are accredited. Remuneration and expenses of delegates of the Protecting Powers shall be subject to agreement between those Powers and the States whose interests they are safeguarding.

    CHAPTER II

    SPECIAL PROTECTION

    Article 11

    IMPROVISED REFUGES

    1. If, during an armed conflict, any High Contracting Party is induced by unforeseen circumstances to set up an improvised refuge and desires that it should be placed under special protection, it shall communicate this fact forthwith to the Commissioner-General accredited to that Party.

    2. If the Commissioner-General considers that such a measure is justified by the circumstances and by the importance of the cultural property sheltered in this improvised refuge, he may authorize the High Contracting Party to display on such refuge the distinctive emblem defined in Article 16 of the Convention. He shall communicate his decision without delay to the delegates of the Protecting Powers who are concerned, each of whom may, within a time-limit of 30 days, order the immediate withdrawal of the emblem.

    3. As soon as such delegates have signified their agreement or if the time-limit of 30 days has passed without any of the delegates concerned having made an objection, and if, in the view of the Commissioner-General, the refuge fulfils the conditions laid down in Article 8 of the Convention, the Commissioner-General shall request the Director-General of the United Nations Educational, Scientific and Cultural Organization to enter the refuge in the Register of Cultural Property under Special Protection.

    Article 12

    INTERNATIONAL REGISTER OF CULTURAL PROPERTY UNDER SPECIAL PROTECTION

    1. An “International Register of Cultural Property under Special Protection” shall be prepared.

    2. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall maintain this Register. He shall furnish copies to the Secretary-General of the United Nations and to the High Contracting Parties.

    3. The Register shall be divided into sections, each in the name of a High Contracting Party. Each section shall be sub-divided into three paragraphs, headed: Refuges, Centres containing Monuments, Other Immovable Cultural Property. The Director-General shall determine what details each section shall contain.

    Article 13

    REQUESTS FOR REGISTRATION

    1. Any High Contracting Party may submit to the Director-General of the United Nations Educational, Scientific and Cultural Organization an application for the entry in the Register of certain refuges, centres containing monuments or other immovable cultural property situated within its territory. Such application shall contain a description of the location of such property and shall certify that the property complies with the provisions of Article 8 of the Convention.

    2. In the event of occupation, the Occupying Power shall be competent to make such application.

    3. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall, without delay, send copies of applications for registration to each of the High Contracting Parties.

    Article 14

    OBJECTIONS

    1. Any High Contracting Party may, by letter addressed to the Director-General of the United Nations Educational, Scientific and Cultural Organization, lodge an objection to the registration of cultural property. This letter must be received by him within four months of the day on which he sent a copy of the application for registration.

    2. Such objection shall state the reasons giving rise to it, the only valid grounds being that:

    (a) the property is not cultural property;

    (b) the property does not comply with the conditions mentioned in Article 8 of the Convention.

    3. The Director-General shall send a copy of the letter of objection to the High Contracting Parties without delay. He shall, if necessary, seek the advice of the International Committee on Monuments, Artistic and Historical Sites and Archaeological Excavations and also, if he thinks fit, of any other competent organization or person.

    4. The Director-General, or the High Contracting Party requesting registration, may make whatever representations they deem necessary to the High Contracting Parties which lodged the objection, with a view to causing the objection to be withdrawn.

    5. If a High Contracting Party which has made an application for registration in time of peace becomes involved in an armed conflict before the entry has been made, the cultural property concerned shall at once be provisionally entered in the Register, by the Director-General, pending the confirmation, withdrawal or cancellation of any objection that may be, or may have been, made.

    6. If, within a period of six months from the date of receipt of the letter of objection, the Director-General has not received from the High Contracting Party lodging the objection a communication stating that it has been withdrawn, the High Contracting Party applying for registration may request arbitration in accordance with the procedure in the following paragraph.

    7. The request for arbitration shall not be made more than one year after the date of receipt by the Director-General of the letter of objection. Each of the two Parties to the dispute shall appoint an arbitrator. When more than one objection has been lodged against an application for registration, the High Contracting Parties which have lodged the objections shall, by common consent, appoint a single arbitrator. These two arbitrators shall select a chief arbitrator from the international list mentioned in Article 1 of the present Regulations. If such arbitrators cannot agree upon their choice, they shall ask the President of the International Court of Justice to appoint a chief arbitrator who need not necesarily be chosen from the international list. The arbitral tribunal thus constituted shall fix its own procedure. There shall be no appeal from its decisions.

    8. Each of the High Contracting Parties may declare, whenever a dispute to which it is a Party arises, that it does not wish to apply the arbitration procedure provided for in the preceding paragraph. In such cases, the objection to an application for registration shall be submitted by the Director-General to the High Contracting Parties. The objection will be confirmed only if the High Contracting Parties so decide by a two-third majority of the High Contracting Parties voting. The vote shall be taken by correspondence, unless the Director-General of the United Nations Educational, Scientific and Cultural Organization deems it essential to convene a meeting under the powers conferred upon him by Article 27 of the Convention. If the Director-General decides to proceed with the vote by correspondence, he shall invite the High Contracting Parties to transmit their votes by sealed letter within six months from the day on which they were invited to do so.

    Article 15

    REGISTRATION

    1. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall cause to be entered in the Register, under a serial number, each item of property for which application for registration is made, provided that he has not received an objection within the time-limit prescribed in paragraph 1 of Article 14.

    2. If an objection has been lodged, and without prejudice to the provision of paragraph 5 of Article 14, the Director-General shall enter property in the Register only if the objection has been withdrawn or has failed to be confirmed following the procedures laid down in either paragraph 7 or paragraph 8 of Article 14.

    3. Whenever paragraph 3 of Article 11 applies, the Director-General shall enter property in the Register if so requested by the Commissioner-General for Cultural Property.

    4. The Director-General shall send without delay to the Secretary-General of the United Nations, to the High Contracting Parties, and, at the request of the Party applying for registration, to all other States referred to in Articles 30 and 32 of the Convention, a certified copy of each entry in the Register. Entries shall become effective thirty days after despatch of such copies.

    Article 16

    CANCELLATION

    1. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall cause the registration of any property to be cancelled:

    (a) at the request of the High Contracting Party within whose territory the cultural property is situated;

    (b) if the High Contracting Party which requested registration has denounced the Convention, and when that denunciation has taken effect;

    (c) in the special case provided for in Article 14, paragraph 5, when an objection has been confirmed following the procedures mentioned either in paragraph 7 or in paragraph 8 of Article 14.

    2. The Director-General shall send without delay, to the Secretary-General of the United Nations and to all States which received a copy of the entry in the Register, a certified copy of its cancellation. Cancellation shall take effect thirty days after the despatch of such copies.

    CHAPTER III

    TRANSPORT OF CULTURAL PROPERTY

    Article 17

    PROCEDURE TO OBTAIN IMMUNITY

    1. The request mentioned in paragraph 1 of Article 12 of the Convention shall be addressed to the Commissioner-General for Cultural Property. It shall mention the reasons on which it is based and specify the approximate number and the importance of the objects to be transferred, their present location, the location now envisaged, the means of transport to be used, the route to be followed, the date proposed for the transfer, and any other relevant information.

    2. If the Commissioner-General, after taking such opinions as he deems fit, considers that such transfer is justified, he shall consult those delegates of the Protecting Powers who are concerned, on the measures proposed for carrying it out. Following such consultation, he shall notify the Parties to the conflict concerned of the transfer, including in such notification all useful information.

    3. The Commissioner-General shall appoint one or more inspectors, who shall satisfy themselves that only the property stated in the request is to be transferred and that the transport is to be by the approved methods and bears the distinctive emblem. The inspector or inspectors shall accompany the property to its destination.

    Article 18

    TRANSPORT ABROAD

    Where the transfer under special protection is to the territory of another country, it shall be governed not only by Article 12 of the Convention and by Article 17 of the present Regulations, but by the following further provisions:

    (a) while the cultural property remains on the territory of another State, that State shall be its depositary and shall extend to it as great a measure of care as that which it bestows upon its own cultural property of comparable importance;

    (b) the depositary State shall return the property only on the cessation of the conflict; such return shall be effected within six months from the date on which it was requested;

    (c) during the various transfer operations, and while it remains on the territory of another State, the cultural property shall be exempt from confiscation and may not be disposed of either by the depositor or by the depositary. Nevertheless, when the safety of the property requires it, the depositary may, with the assent of the depositor, have the property transported to the territory of a third country, under the conditions laid down in the present article;

    (d) the request for special protection shall indicate that the State to whose territory the property is to be transferred accepts the provisions of the present Article.

    Article 19

    OCCUPIED TERRITORY

    Whenever a High Contracting Party occupying territory of another High Contracting Party transfers cultural property to a refuge situated elsewhere in that territory, without being able to follow the procedure provided for in Article 17 of the Regulations, the transfer in question shall not be regarded as misappropriation within the meaning of Article 4 of the Convention, provided that the Commissioner-General for Cultural Property certifies in writing, after having consulted the usual custodians, that such transfer was rendered necessary by circumstances.

    CHAPTER IV

    THE DISTINCTIVE EMBLEM

    Article 20

    AFFIXING OF THE EMBLEM

    1. The placing of the distinctive emblem and its degree of visibility shall be left to the discretion of the competent authorities of each High Contracting Party. It may be displayed on flags or armlets; it may be painted on an object or represented in any other appropriate form.

    2. However, without prejudice to any possible fuller markings, the emblem shall, in the event of armed conflict and in the cases mentioned in Articles 12 and 13 of the Convention, be placed on the vehicles of transport so as to be clearly visible in daylight from the air as well as from the ground.

    The emblem shall be visible from the ground:

    (a) at regular intervals sufficient to indicate clearly the perimeter of a centre containing monuments under special protection;

    (b) at the entrance to other immovable cultural property under special protection.

    Article 21

    IDENTIFICATION OF PERSONS

    1. The persons mentioned in Article 17, paragraph 2 (b) and (c) of the Convention may wear an armlet bearing the distinctive emblem, issued and stamped by the competent authorities.

    2. Such persons shall carry a special identity card bearing the distinctive emblem. This card shall mention at least the surname and first names, the date of birth, the title or rank, and the function of the holder. The card shall bear the photograph of the holder as well as his signature or his fingerprints, or both. It shall bear the embossed stamp of the competent authorities.

    3. Each High Contracting Party shall make out its own type of identity card, guided by the model annexed, by way of example, to the present Regulations. The High Contracting Parties shall transmit to each other a specimen of the model they are using. Identity cards shall be made out, if possible, at least in duplicate, one copy being kept by the issuing Power.

    4. The said persons may not, without legitimate reason, be deprived of their identity card or of the right to wear the armlet.


    CONVENÇÃO PARA A PROTECÇÃO DOS BENS CULTURAIS EM CASO DE CONFLITO ARMADO, FEITA NA HAIA, EM 14 DE MAIO DE 1954

    As Altas Partes Contratantes,

    Considerando que os bens culturais sofreram graves danos durante os últimos conflitos e que eles se encontram cada vez mais ameaçados de destruição devido ao desenvolvimento de tecnologia de guerra;

    Convencidos de que os atentados perpetrados contra os bens culturais, qualquer que seja o povo a quem eles pertençam, constituem atentados contra o património cultural de toda a humanidade, sendo certo que cada povo dá à sua contribuição para a cultura mundial;

    Considerando que a conservação do património cultural apresenta uma grande importância para todos os povos do mundo e que importa assegurar a este património uma protecção internacional;

    Guiados pelos princípios respeitantes à protecção dos bens culturais em caso de conflito armado estabelecidos nas Convenções da Haia de 1899 e de 1907 e no Pacto de Washington, de 15 de Abril de 1935;

    Considerando que, para ser eficaz, a protecção destes bens deve ser organizada em tempo de paz através de medidas quer nacionais quer internacionais;

    Determinadas a adoptar todas as disposições possíveis para proteger os bens culturais;

    Acordam no seguinte:

    CAPÍTULO I

    Disposições gerais respeitantes à protecção

    Artigo 1.º

    Definição de bens culturais

    Para fins da presente Convenção são considerados «bens culturais», qualquer que seja a sua origem ou o seu proprietário:

    a) Os bens, móveis ou imóveis que apresentem uma grande importância para o património cultural dos povos, tais como os monumentos de arquitectura, de arte ou de história, religiosos ou laicos; os sítios arqueológicos; os conjuntos de construções que, enquanto tal, apresentem um interesse histórico ou artístico; as obras de arte; os manuscritos, livros e outros objectos de interesse artístico, histórico ou arqueológico; assim como as colecções científicas e as colecções importantes de livros ou arquivos ou reproduções dos bens supra definidos;

    b) Os edifícios cujo objectivo principal e efectivo seja de conservar ou de expor os bens culturais móveis definidos na alínea a), tais como os museus, as grandes bibliotecas e os depósitos de arquivos e ainda os refúgios destinados a abrigar os bens culturais móveis definidos na alínea a) em caso de conflito armado;

    c) Os centros que contenham um número considerável de bens culturais tal como definidos nas alíneas a) e b), os chamados «centros monumentais».

    Artigo 2.º

    Protecção dos bens culturais

    Para fins da presente Convenção a protecção dos bens culturais comporta a salvaguarda e o respeito por estes bens.

    Artigo 3.º

    Salvaguarda dos bens culturais

    As Altas Partes Contratantes comprometem-se a preparar, em tempo de paz, a salvaguarda dos bens culturais situados no seu próprio território contra os efeitos previsíveis de um conflito armado, adoptando as medidas que considerem apropriadas.

    Artigo 4.º

    Respeito pelos bens culturais

    1. As Altas Partes Contratantes comprometem-se a respeitar os bens culturais situados quer no seu próprio território quer no território das outras Altas Partes Contratantes, não se permitindo a utilização desses bens, dos seus dispositivos de protecção e dos acessos imediatos para fins que poderiam expor esses bens a uma destruição ou deterioração em caso de conflito armado, devendo também abster-se de qualquer acto de hostilidade em relação a esses bens.

    2. As obrigações definidas no n.º 1 do presente artigo não poderão sofrer derrogações, excepto no caso em que uma necessidade militar exija de uma maneira imperativa uma tal derrogação.

    3. As Altas Partes Contratantes comprometem-se ainda a proibir, a prevenir e, caso seja necessário, a fazer cessar todo o acto de roubo, de pilhagem ou de desvio de bens culturais, qualquer que seja a sua forma, bem como todo o acto de vandalismo em relação aos referidos bens. As Partes impedem a requisição dos bens culturais móveis que se situem no território de uma outra Alta Parte Contratante.

    4. As Partes proíbem qualquer acção de represália que atinja os bens culturais.

    5. Uma Alta Parte Contratante não se pode desvincular das obrigações estipuladas no presente artigo em relação a uma outra Alta Parte Contratante com fundamento na não adopção das medidas de salvaguarda prescritas no artigo 3.º por parte desta última.

    Artigo 5.º

    Ocupação

    1. As Altas Partes Contratantes que ocupem total ou parcialmente o território de uma outra Alta Parte Contratante devem, na medida do possível, apoiar os esforços das autoridades nacionais competentes do território ocupado de forma a assegurar a salvaguarda e a conservação dos seus bens culturais.

    2. Se for necessária uma intervenção urgente para a conservação dos bens culturais situados em território ocupado e danificados por operações militares, e se as autoridades nacionais competentes não puderem encarregar-se disso, deve a Potência Ocupante adoptar, tanto quanto possível, as medidas de conservação mais prementes em estreita colaboração com as autoridades.

    3. Qualquer Alta Parte Contratante cujo governo seja considerado pelos membros de um movimento de resistência como o seu governo legítimo, chamará, se possível, a atenção desses membros para a obrigação de observar aquelas disposições da Convenção referentes ao respeito pelos bens culturais.

    Artigo 6.º

    Sinalização dos bens culturais

    Em conformidade com as disposições do artigo 16.º, os bens culturais podem ser munidos de um sinal distintivo de modo a facilitar a sua identificação.

    Artigo 7.º

    Medidas de ordem militar

    1. As Altas Partes Contratantes comprometem-se a introduzir em tempo de paz nos regulamentos ou instituições destinados à utilização pelas suas tropas disposições próprias para assegurar a observação da presente Convenção, e a incutir ao pessoal das suas forças armadas em tempo de paz um espírito de respeito pelas culturas e pelos bens culturais de todos os povos.

    2. As Partes comprometem-se a preparar ou a estabelecer, em tempo de paz, no seio das suas forças armadas, serviços ou pessoal especializado cuja missão será velar pelo respeito dos bens culturais e colaborar com as autoridades civis encarregadas da salvaguarda destes bens.

    CAPÍTULO II

    Da protecção especial

    Artigo 8.º

    Atribuição de protecção especial

    1. Pode ser posto sob protecção especial um número restrito de refúgios destinados a abrigar os bens culturais móveis de grande importância desde que os mesmos:

    a) Se encontrem a uma distância suficiente de um grande centro industrial ou de qualquer objectivo militar importante que constitua um ponto sensível, como por exemplo um aeródromo, uma estação de radiodifusão, um estabelecimento ao serviço da defesa nacional, um porto ou uma gare de caminhos de ferro com uma certa importância, ou uma grande via de comunicação;

    b) Não sejam utilizados para fins militares.

    2. Um refúgio para bens culturais móveis pode também ser colocado sob protecção especial, qualquer que seja a sua localização, se tiver sido construído de modo que, segundo todas as probabilidades, não seja afectado por bombardeamentos.

    3. Um centro monumental é considerado como utilizado para fins militares quando seja empregue para deslocações de pessoal ou material militar, mesmo em trânsito. O mesmo se passará quando aí se desenvolvam actividades que tenham uma relação directa com operações militares, com o acantonamento do pessoal militar ou com a produção de material bélico.

    4. Não é considerada como utilização para fins militares a vigilância de um dos bens culturais enumerados no n.º 1 supra por guardas armados e especialmente equipados para esse efeito, ou a presença, próxima desse bem cultural, de forças de polícia normalmente encarregadas de assegurar a ordem pública.

    5. Se um dos bens culturais enumerados no n.º 1 do presente artigo estiver situado próximo de um objectivo militar importante tal como definido no referido número, ele pode, todavia, ser colocado sob protecção especial desde que a Alta Parte Contratante, que pede essa protecção, se comprometa, em caso de conflito armado, a não fazer uso do objectivo em causa e, nomeadamente, se se tratar de um porto, de uma gare ou de um aeródromo, a desviar todo o tráfego. Neste caso o desvio de tráfego deve ser organizado em tempo de paz.

    6. A protecção especial é concedida aos bens culturais através da sua inscrição no «Registo Internacional dos Bens Culturais sob Protecção Especial». Esta inscrição só poderá ser efectuada em conformidade com as disposições da presente Convenção e nas condições previstas no Regulamento de execução da Convenção.

    Artigo 9.º

    Imunidade dos bens culturais sob protecção especial

    As Altas Partes Contratantes comprometem-se a assegurar a imunidade dos bens culturais sob protecção especial através de interdição, a partir da inscrição no Registo Internacional, de qualquer acto de hostilidade em relação a esses bens e, salvo os casos previstos no n.º 5 do artigo 8.º, de qualquer utilização de tais bens ou dos seus acessos para fins militares.

    Artigo 10.º

    Sinalização e controlo

    No decurso de um conflito armado os bens culturais sob protecção especial devem ser munidos de um sinal distintivo definido pelo artigo 16.º e ser abertos a um controlo de carácter internacional tal como previsto no Regulamento de execução da Convenção.

    Artigo 11.º

    Levantamento de imunidade

    1. Se uma das Altas Partes Contratantes cometer, relativamente a um bem cultural sob protecção especial, uma violação dos compromissos assumidos em virtude do artigo 9.º, no período de tempo em que a violação subsistir, a outra Parte fica desobrigada de assegurar a imunidade do bem em causa. Porém, cada vez que esta o possa, deve tomar previamente as diligências de modo a pôr fim a esta violação dentro de um prazo razoável.

    2. Em exclusão do caso previsto no n.º 1 do presente artigo, a imunidade de um bem cultural sob protecção especial não pode ser levantada a não ser em casos excepcionais de necessidade militar inelutável e apenas naquele tempo em que essa necessidade subsiste. Esta só poderá ser constatada por um chefe de uma formação igual ou superior em importância a uma divisão. Em todos os casos que as circunstâncias o permitam, a decisão de levantar a imunidade é notificada com uma antecedência suficiente à Parte contrária.

    3. A Parte que levanta a imunidade deve informar no mais curto prazo possível, por escrito, e com indicação dos seus motivos, o Comissário-Geral para os bens culturais, tal como previsto no Regulamento de execução da Convenção.

    CAPÍTULO III

    Dos transportes de bens culturais

    Artigo 12.º

    Transporte sob protecção especial

    1. Um transporte exclusivamente afectado à transferência de bens culturais, seja para o interior de um território, seja com destino a outro território, pode, a pedido da Alta Parte Contratante interessada, ser efectuado sob protecção especial, nas condições previstas no Regulamento de execução da Convenção.

    2. O transporte sob protecção especial é realizado sob uma vigilância de carácter internacional prevista no Regulamento de execução da Convenção e deve estar munido de um sinal distintivo definido no artigo 16.º

    3. As Altas Partes Contratantes proíbem qualquer acto de hostilidade contra um transporte sob protecção especial.

    Artigo 13.º

    Transporte em caso de urgência

    1. Se uma Alta Parte Contratante julgar que a segurança de certos bens culturais exige a sua transferência, e que há uma urgência tal que o procedimento previsto no artigo 12.º não pode ser seguido, nomeadamente no início de um conflito armado, o transporte pode ser munido de um sinal distintivo definido no artigo 16.º, a menos que ele não tenha sido objecto de um pedido de imunidade no sentido do artigo 12.º e que o dito pedido não tenha sido recusado. Sempre que possível a notificação do transporte deve ser feita às Partes contrárias. O transporte para o território de outro país não pode em caso algum ser munido de um sinal distintivo, se a imunidade não lhe tiver sido concedida expressamente.

    2. As Altas Partes Contratantes tomarão, na medida do possível, as precauções necessárias para que os transportes previstos no n.º 1 do presente artigo e munidos de um sinal distintivo sejam protegidos contra actos de hostilidade dirigidos contra eles.

    Artigo 14.º

    Imunidade de embargo, captura e apreensão

    1. Gozam de imunidade de embargo, captura e de apreensão:

    a) Os bens culturais que beneficiem da protecção prevista no artigo 12.º ou da prevista no artigo 13.º;

    b) Os meios de transporte afectados exclusivamente à transferência destes bens.

    2. Nada do presente artigo limita o direito de visita e de controlo.

    CAPÍTULO IV

    Do pessoal

    Artigo 15.º

    Pessoal

    O pessoal afecto à protecção de bens culturais deve, na medida do compatível com as exigências de segurança, ser respeitado no interesse destes bens e, se ele cair nas mãos de uma Parte contrária, deve poder continuar a exercer as suas funções desde que os bens a seu cargo caiam também nas mãos de Parte contrária.

    CAPÍTULO V

    Do sinal distintivo

    Artigo 16.º

    Sinal da Convenção

    1. O sinal distintivo da Convenção consiste num escudo, pontiagudo em baixo, esquartelado em aspa em azul-real e em branco (um escudete formado por um quadrado azul-real tendo um dos ângulos inscritos na ponta do escudete e de um triângulo azul-real por cima do quadrado, os dois delimitando um triângulo branco de cada lado).

    2. O sinal é utilizado isolado ou repetido três vezes em formação triangular (um sinal em baixo), nas condições previstas no artigo 17.º

    Artigo 17.º

    Utilização do sinal

    1. O sinal distintivo repetido três vezes só pode ser utilizado como um meio de identificação de:

    a) Bens culturais imóveis sob protecção especial;

    b) Transporte de bens culturais, nas condições previstas nos artigos 12.º e 13.º;

    c) Refúgios improvisados, nas condições previstas no Regulamento de execução da Convenção.

    2. O sinal distintivo só pode ser utilizado isoladamente como um meio de identificação de:

    a) Bens culturais que estejam sob protecção especial;

    b) Pessoas encarregadas de funções de controlo em conformidade com o Regulamento de execução da Convenção;

    c) Pessoal afecto à protecção dos bens culturais;

    d) Cartões de identidade previstos no Regulamento de execução da Convenção.

    3. Durante um conflito armado, é proibida a utilização do sinal distintivo em todos os casos não previstos nos números anteriores do presente artigo, e a utilização para qualquer efeito de um sinal semelhante ao sinal distintivo.

    4. O sinal distintivo não pode ser colocado sobre um bem cultural imóvel sem que ao mesmo tempo seja afixada uma autorização devidamente datada e assinada pela autoridade competente da Alta Parte Contratante.

    CAPÍTULO VI

    Do campo de aplicação da Convenção

    Artigo 18.º

    Aplicação da Convenção

    1. Além das disposições que devem entrar em vigor em tempo de paz, a presente Convenção será aplicada em caso de guerra declarada ou de qualquer outro conflito armado que surja entre duas ou mais das Altas Partes Contratantes, mesmo se o estado de guerra não for reconhecido por uma ou mais Partes.

    2. A Convenção será igualmente aplicada em todos os casos de ocupação total ou parcial do território de uma Alta Parte Contratante, mesmo se essa ocupação não encontrar nenhuma resistência militar.

    3. Se uma das Potências em conflito não for Parte na presente Convenção, as Potências que nela sejam Parte ficarão contudo ligadas pela mesma nas suas relações recíprocas. Elas estarão ligadas ainda pela Convenção relativamente à Potência que não seja Parte, se esta tiver declarado aceitar as disposições e desde que as aplique.

    Artigo 19.º

    Conflitos de carácter não internacional

    1. Em caso de conflito armado que não apresente um carácter internacional que surja no território de uma das Altas Partes Contratantes, cada uma das partes no conflito deverá aplicar, pelo menos, as disposições da presente Convenção que obrigam ao respeito dos bens culturais.

    2. As Partes no conflito procederão no sentido de pôr em vigor, por via de acordos especiais, todas, ou parte, das outras disposições da presente Convenção.

    3. A Organização das Nações Unidas para a Educação, Ciência e Cultura pode oferecer os seus serviços às partes no conflito.

    4. A aplicação das disposições precedentes não produzirá efeitos sobre o estatuto jurídico das partes no conflito.

    CAPÍTULO VII

    Da execução da Convenção

    Artigo 20.º

    Regulamento de Execução da Convenção

    As modalidades de aplicação da presente Convenção são determinadas pelo seu Regulamento de execução, da qual é parte integrante.

    Artigo 21.º

    Potências Protectoras

    A presente Convenção e o seu Regulamento de execução são aplicados com a concordância das Potências Protectoras encarregadas da salvaguarda dos interesses das Partes no conflito.

    Artigo 22.º

    Processo de conciliação

    1. As Potências Protectoras prestam os seus bons serviços em todos os casos que julguem ser útil e no interesse dos bens culturais, especialmente se houver algum desacordo entre as Partes no conflito sobre a aplicação ou a interpretação das disposições da presente Convenção ou do seu Regulamento de execução.

    2. Para este efeito, cada uma das Potências Protectoras pode, a convite de uma Parte, do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, ou por sua própria iniciativa, propor às Partes no conflito uma reunião dos seus representantes e, em particular, das autoridades encarregadas da protecção dos bens culturais, eventualmente em território neutro escolhido convenientemente. As Partes no conflito devem dar seguimento às propostas da reunião que lhes sejam feitas. As Potências Protectoras propõem, de acordo com as Partes no conflito, uma personalidade pertencente a uma Potência neutra, ou apresentada pelo Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, que é chamada a participar nesta reunião na qualidade de presidente.

    Artigo 23.º

    Cooperação da UNESCO

    1. As Altas Partes Contratantes podem fazer apelo à cooperação tecnológica da Organização das Nações Unidas para a Educação, Ciência e Cultura tendo em vista a organização da protecção dos seus bens culturais, ou a propósito de qualquer outro problema resultante da aplicação da presente Convenção ou seu Regulamento de execução. A Organização acorda esta cooperação nos limites do seu programa e das suas possibilidades.

    2. A Organização está habilitada a apresentar, por sua própria iniciativa, propostas sobre esta questão às Altas Partes Contratantes.

    Artigo 24.º

    Acordos especiais

    1. As Altas Partes Contratantes podem concluir acordos especiais sobre qualquer questão que lhes pareça oportuno regular separadamente.

    2. Não pode ser concluído nenhum acordo especial que diminua a protecção assegurada pela presente Convenção aos bens culturais e ao pessoal que lhes está afecto.

    Artigo 25.º

    Difusão da Convenção

    As Altas Partes Contratantes obrigam-se a difundir o mais amplamente possível, em tempo de paz e em tempo de conflito armado, o texto da presente Convenção e o seu Regulamento de execução nos respectivos países. Comprometem-se, nomeadamente, a incorporar o estudo dos mesmos nos seus programas de instrução militar e, se possível, civil, de tal maneira que os princípios possam ser conhecidos do conjunto da população, em particular das forças armadas e do pessoal afecto à protecção dos bens culturais.

    Artigo 26.º

    Traduções e relatórios

    1. As Altas Partes Contratantes comunicam entre elas, por intermédio do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, as traduções oficiais da presente Convenção e do seu Regulamento de execução.

    2. Além do mais, pelo menos uma vez em cada quatro anos, elas dirigem ao Director-Geral um relatório apresentando informações que julguem oportunas sobre as medidas adoptadas, preparadas e verificadas pelas suas respectivas administrações em aplicação da presente Convenção e do seu Regulamento de execução.

    Artigo 27.º

    Reuniões

    1. O Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura pode, com a aprovação do Conselho Executivo, convocar reuniões de representantes das Altas Partes Contratantes. É obrigado a fazê-lo se, pelo menos, um quinto das Altas Partes Contratantes assim o requisitar.

    2. Sem prejuízo de todas as outras funções que lhe são conferidas pela presente Convenção ou pelo seu Regulamento de execução, a reunião tem como propósito estudar os problemas relativos à aplicação da Convenção e do seu Regulamento de execução, e de formular recomendações a este propósito.

    3. A reunião pode, além do mais, proceder à revisão da Convenção ou do seu Regulamento de execução se a maioria das Altas Partes Contratantes se encontrar representada, em conformidade com as disposições do artigo 39.º

    Artigo 28.º

    Sanções

    As Altas Partes Contratantes comprometem-se a adoptar, no quadro do seu sistema de direito penal, todas as medidas necessárias para que sejam encontradas e aplicadas as sanções penais e disciplinares às pessoas, qualquer que seja a sua nacionalidade, que cometeram ou deram ordem para cometer uma infracção à presente Convenção.

    Disposições finais

    Artigo 29.º

    Línguas

    1. A presente Convenção é redigida em inglês, espanhol, francês e russo, tendo os quatro textos o mesmo valor.

    2. A Organização das Nações Unidas para a Educação, Ciência e Cultura providenciará traduções nas outras línguas oficiais da sua Conferência Geral.

    Artigo 30.º

    Assinatura

    A presente Convenção será datada de 14 de Maio de 1954 e ficará aberta até 31 de Dezembro de 1954 para a assinatura de todos os Estados convidados para a Conferência que se reuniu na Haia entre 21 de Abril e 14 de Maio de 1954.

    Artigo 31.º

    Ratificação

    1. A presente Convenção será submetida à ratificação dos Estados signatários em conformidade com os seus procedimentos constitucionais respectivos.

    2. Os instrumentos de ratificação serão depositados junto do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura.

    Artigo 32.º

    Adesão

    A contar do dia da sua entrada em vigor, a presente Convenção estará aberta à adesão de todos os Estados visados no artigo 30.º que não a tenham assinado, assim como de todos os Estados convidados a aderir pelo Conselho Executivo da Organização das Nações Unidas para a Educação, Ciência e Cultura. A adesão far-se-á pelo depósito de um instrumento de adesão junto do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura.

    Artigo 33.º

    Entrada em vigor

    1. A presente Convenção entrará em vigor três meses após o depósito de cinco instrumentos de ratificação.

    2. Posteriormente, entrará em vigor, para cada Alta Parte Contratante, três meses após o depósito do seu instrumento de ratificação ou de adesão.

    3. As situações previstas nos artigos 18.º e 19.º darão efeitos imediatos às ratificações e às adesões depositadas pelas Partes no conflito antes ou depois do início das hostilidades ou da ocupação. Nestes casos o Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura fará, pela via mais rápida, as comunicações previstas no artigo 38.º

    Artigo 34.º

    Aplicação efectiva

    1. Os Estados Partes na Convenção à data da sua entrada em vigor adoptarão, cada um no que lhe diga respeito, todas as medidas requeridas para a sua aplicação efectiva no prazo de seis meses.

    2. Este prazo será de seis meses a contar da data do depósito do instrumento de ratificação ou de adesão para todos os Estados que depositem o seu instrumento de ratificação ou de adesão após a data da entrada em vigor da Convenção.

    Artigo 35.º

    Extensão territorial da Convenção

    Qualquer Alta Parte Contratante poderá, no momento da ratificação ou da adesão, ou em qualquer momento posterior, declarar através de uma notificação dirigida ao Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, que a presente Convenção poderá estender-se a um conjunto ou a qualquer um dos territórios onde ela assegure as relações internacionais. A referida notificação produzirá efeitos passados três meses da data da sua recepção.

    Artigo 36.º

    Relação com as Convenções anteriores

    1. Nas relações entre Potências que estejam ligadas pelas Convenções da Haia respeitantes às Leis e Costumes da Guerra em Terra (IV) e respeitantes ao Bombardeamento por Forças Navais em Tempo de Guerra (IX), quer se trate das de 29 de Julho de 1899 ou das de 18 de Outubro de 1907, e que são Partes na presente Convenção, esta última completará a supra referida Convenção (IX) e o regulamento anexo à supra mencionada Convenção (IV) e substituirá o sinal definido no artigo 5.º da supra referida Convenção (IX) pelo sinal definido no artigo 16.º da presente Convenção para os casos em que esta e o seu Regulamento de execução prevejam a utilização deste sinal distintivo.

    2. Nas relações entre Potências ligadas pelo Pacto de Washington, de 15 de Abril de 1935, para a Protecção de Instituições Artísticas e Científicas e de Monumentos Históricos (Pacto Roerich), e que sejam Partes na presente Convenção, esta última completará o Pacto Roerich e substituirá a bandeira distintiva definida no artigo III do Pacto pelo sinal definido no artigo 16.º da presente Convenção, nos casos em que esta e o seu Regulamento de execução prevejam o emprego deste sinal distintivo.

    Artigo 37.º

    Denúncia

    1. Cada uma das Altas Partes Contratantes terá a faculdade de denunciar a presente Convenção em seu próprio nome ou em nome de qualquer território onde ela garanta as relações internacionais.

    2. A denúncia será notificada mediante um instrumento escrito depositado junto do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura.

    3. A denúncia produzirá efeitos um ano após a recepção do instrumento de denúncia. Se, todavia, no final desse ano, a Parte denunciante se encontrar envolvida num conflito armado, o efeito da denúncia ficará suspenso até ao fim das hostilidades e em todos os casos durante o período de tempo em que se processem as operações de repatriamento dos bens culturais.

    Artigo 38.º

    Notificações

    O Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura informará os Estados visados nos artigos 30.º e 32.º, assim como a Organização das Nações Unidas, do depósito de todos os instrumentos de ratificação, de adesão ou de aceitação mencionados nos artigos 31.º, 32.º e 39.º, e das notificações e denúncias previstas, respectivamente, nos artigos 35.º, 37.º e 39.º

    Artigo 39.º

    Revisão da Convenção e do seu Regulamento de execução

    1. Cada uma das Altas Partes Contratantes pode propor emendas à presente Convenção e ao seu Regulamento de execução. O texto de qualquer emenda proposta será comunicado ao Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, que o transmitirá a todas as Altas Partes Contratantes solicitando-lhes ao mesmo tempo que dêem a conhecer a resposta no prazo de quatro meses:

    a) Se desejam que seja convocada uma Conferência para estudar a emenda proposta;

    b) Ou se são da opinião de que a emenda proposta deve ser aceite sem a convocação de uma Conferência;

    c) Ou se são da opinião de que a emenda proposta deve ser rejeitada sem a convocação de uma Conferência.

    2. O Director-Geral transmitirá as respostas, recebidas em aplicação do n.º 1 do presente artigo, a todas as Altas Partes Contratantes.

    3. Se todas as Altas Partes Contratantes que tenham, no prazo previsto, dado a conhecer os seus pontos de vista ao Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, em conformidade com alínea b) do n.º 1 do presente artigo, informam o Director-Geral de que são a favor da adopção da emenda sem a realização de uma Conferência, a notificação da sua decisão será feita pelo Director-Geral em conformidade com o artigo 38.º A emenda produzirá efeitos em relação a todas as Altas Partes Contratantes no prazo de 90 dias a contar da data desta notificação.

    4. O Director-Geral convocará uma Conferência das Altas Partes Contratantes, tendo em vista o estudo da emenda proposta se o pedido lhe for feito por mais de um terço das Altas Partes Contratantes.

    5. As emendas à Convenção ou ao seu Regulamento de execução, submetidas ao procedimento previsto no número anterior, só entrarão em vigor após terem sido adoptadas por unanimidade pelas Altas Partes Contratantes representadas na Conferência e após terem sido aceites por cada uma das Altas Partes Contratantes.

    6. A aceitação pelas Altas Partes Contratantes das emendas à Convenção ou ao seu Regulamento de execução, que tiverem sido adoptadas pela Conferência referida nos números 4 e 5, realizar-se-á mediante o depósito de um instrumento formal junto do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura.

    7. Após a entrada em vigor de emendas à presente Convenção ou ao seu Regulamento de execução, somente o texto assim modificado da referida Convenção ou do seu Regulamento de execução ficará aberto à ratificação ou à adesão.

    Artigo 40.º

    Registo

    Em conformidade com o artigo 102.º da Carta das Nações Unidas, a presente Convenção será registada no Secretariado das Nações Unidas a requerimento do Director-Geral da Organização das Nações Unidas para Educação, Ciência e Cultura.

    EM FÉ DO QUE os abaixo assinados, devidamente autorizados pelos respectivos governos, assinaram a presente Convenção.

    FEITA na Haia, aos 14 dias do mês de Maio de, 1954, num só exemplar, que será depositado nos arquivos da Organização das Nações Unidas para a Educação, Ciência e Cultura, e cujas cópias certificadas conforme o original serão remetidas a todos os Estados visados nos artigos 30.º e 32.º, bem como à Organização das Nações Unidas.

    REGULAMENTO DE EXECUÇÃO DA CONVENÇÃO PARA A PROTECÇÃO DE BENS CULTURAIS EM CASO DE CONFLITO ARMADO

    CAPÍTULO I

    Do controlo

    Artigo 1.º

    Lista internacional de personalidades

    Desde a entrada em vigor da Convenção, o Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura elaborou uma lista internacional composta por todas as personalidades designadas pelas Altas Partes Contratantes como estando aptas a desempenhar as funções de Comissário-Geral para os Bens Culturais. Esta lista será objecto de revisões periódicas, por iniciativa do Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, com base em pedidos formulados pelas Altas Partes Contratantes.

    Artigo 2.º

    Organização do controlo

    Quando uma Alta Parte Contratante participa num conflito armado ao qual é aplicável o artigo 18.º da Convenção:

    a) Esta nomeia um representante para os bens culturais situados no seu território; se estes ocuparem outro território, deverá nomear um representante especial para os bens culturais situados nesse território;

    b) A Potência Protectora de cada Parte adversária dessa Alta Parte Contratante nomeia delegados junto desta última, em conformidade com o artigo 3.º;

    c) Um Comissário-Geral para os Bens Culturais é nomeado junto dessa Alta Parte Contratante, em conformidade com o artigo 4.º

    Artigo 3.º

    Designação de delegados de Potências Protectoras

    A Potência Protectora nomeia os seus delegados de entre os membros do seu pessoal diplomático ou consular ou, com o acordo da Parte junto da qual a sua missão será exercida, de entre outras pessoas.

    Artigo 4.º

    Designação do Comissário-Geral

    1. O Comissário-Geral para os bens culturais é escolhido por mútuo acordo, da lista internacional de personalidades, pela Parte junto da qual exercerá a sua missão e pelas Potências Protectoras das Partes contrárias.

    2. Se as Partes não conseguirem chegar a acordo nas três semanas seguintes à abertura das conversações sobre este ponto, solicitarão ao Presidente do Tribunal Internacional de Justiça que nomeie o Comissário-Geral, o qual só assumirá funções após a obtenção do acordo da Parte junto da qual ele deverá exercer a sua missão.

    Artigo 5.º

    Atribuições dos delegados

    Os delegados das Potências Protectoras tomam nota das violações à Convenção, investigam, com o consentimento da Parte junto da qual exercem a sua missão, as circunstâncias nas quais estas ocorreram, procedem a diligências no local a fim de as fazer cessar e, caso necessário, notificam tais violações ao Comissário-Geral. Eles mantêm-no ao corrente das suas actividades.

    Artigo 6.º

    Atribuições do Comissário-Geral

    1. O Comissário-Geral para os Bens Culturais trata juntamente com o representante da Parte junto da qual ele exerce a sua missão e com os delegados interessados, as questões respeitantes à Convenção que lhe são dadas a conhecer.

    2. Tem, nos casos previstos no presente Regulamento, o poder de decisão e de nomeação.

    3. Tem, com o acordo da Parte junto da qual ele exerce a sua missão, o direito de ordenar uma investigação ou de conduzi-la ele mesmo.

    4. Toma todas as diligências, junto das Partes no conflito ou das suas Potências Protectoras, que julgue úteis para a aplicação da Convenção.

    5. Elabora os relatórios necessários sobre a aplicação da Convenção e comunica-os às Partes interessadas e às suas Potências Protectoras. Remete cópias ao Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, o qual só poderá utilizar os seus conteúdos técnicos.

    6. Quando não existir Potência Protectora, o Comissário-Geral exerce as funções atribuídas à Potência Protectora, nos termos dos artigos 21.º e 22.º da Convenção.

    Artigo 7.º

    Inspectores e peritos

    1. Sempre que o Comissário-Geral para os Bens Culturais, a pedido dos delegados interessados ou após consulta com os mesmos, o julgue necessário, propõe, com o acordo da Parte junto da qual exerce a sua missão, uma pessoa na qualidade de inspector de bens culturais encarregada de uma missão específica. Um inspector será apenas responsável perante o Comissário-Geral.

    2. O Comissário-Geral, os delegados e os inspectores podem recorrer aos serviços de peritos, que serão igualmente propostos com o acordo com a Parte mencionada no número anterior.

    Artigo 8.º

    Exercício da missão de controlo

    Os Comissários-Gerais para os Bens Culturais, os delegados das Potências Protectoras, os inspectores e os peritos não devem em caso algum exceder os limites dos seus mandatos. Devem, nomeadamente, ter em conta as necessidades de segurança da Alta Parte Contratante junto da qual exercem a sua missão e agir em todas as circunstâncias de acordo com as exigências da situação militar tais como lhes sejam comunicadas pela referida Alta Parte Contratante.

    Artigo 9.º

    Substitutos das Potências Protectoras

    Se uma Parte no conflito não beneficia ou deixa de beneficiar da actividade de uma Potência Protectora, um Estado neutro pode ser solicitado a assumir as funções de Potência Protectora tendo em vista a nomeação de um Comissário-Geral para os Bens Culturais em conformidade com o procedimento previsto no artigo 4.º supra referido. O Comissário-Geral assim nomeado confia eventualmente a inspectores as funções de delegados das Potências Protectoras previstas no presente Regulamento.

    Artigo 10.º

    Despesas

    A remuneração e as despesas do Comissário-Geral para os Bens Culturais, dos inspectores e dos peritos serão da responsabilidade da Parte junto da qual a sua missão é exercida; as dos delegados das Potências Protectoras são objecto de um entendimento entre estas Potências e os Estados cujos interesses salvaguardam.

    CAPÍTULO II

    Da protecção especial

    Artigo 11.º

    Refúgios improvisados

    1. Se uma Alta Parte Contratante, no decurso de um conflito armado, se vir obrigada por circunstâncias imprevistas a construir um refúgio improvisado e desejar que este seja colocado sob protecção especial, deve comunicá-lo imediatamente ao Comissário-Geral que exerce a sua função junto dela.

    2. Se o Comissário-Geral for da opinião de que as circunstâncias e a importância dos bens culturais abrigados nesse refúgio improvisado justificam tal medida, pode autorizar a Alta Parte Contratante a afixar nele o sinal distintivo definido no artigo 6.º da Convenção. Deve comunicar a sua decisão imediatamente aos delegados interessados das Potências Protectoras podendo cada um deles, no prazo de 30 dias, ordenar a retirada imediata do sinal distintivo.

    3. A partir do momento em que os delegados notificam o seu acordo ou se o prazo de 30 dias expirar sem que qualquer dos delegados interessados tenha formulado qualquer objecção e se o refúgio improvisado preencher, segundo a opinião do Comissário-Geral, as condições previstas no artigo 8.º da Convenção, o Comissário-Geral solicita ao Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura a inscrição do refúgio no Registo dos Bens Culturais sob Protecção Especial.

    Artigo 12.º

    Registo Internacional dos Bens Culturais sob

    Protecção Especial

    1. É criado um «Registo Internacional dos Bens Culturais sob Protecção Especial».

    2. O Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura fica na posse desse Registo. Ele remete cópias do Registo ao Secretário-Geral da Organização das Nações Unidas, bem como às Altas Partes Contratantes.

    3. O Registo é dividido em secções, cada uma delas em nome de uma Alta Parte Contratante. Cada secção é subdividida em três parágrafos intitulados: Refúgios, Centros Monumentais, Outros Bens Culturais Imóveis. O Director-Geral determina quais as menções que devem constar de cada secção.

    Artigo 13.º

    Pedidos de inscrição

    1. Cada uma das Altas Partes Contratantes pode submeter ao Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura pedidos de inscrição no Registo de determinados refúgios, centros monumentais ou outros bens culturais imóveis situados no seu território. Tais pedidos devem indicar a localização desses bens e certificar que estes preenchem os requisitos previstos no artigo 8.º da Convenção.

    2. Em caso de ocupação, a Potência Ocupante tem a faculdade de formular pedidos de inscrição.

    3. O Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura remete, sem demora, uma cópia dos pedidos de inscrição a cada uma das Altas Partes Contratantes.

    Artigo 14.º

    Objecções

    1. Cada uma das Altas Partes Contratantes pode formular uma objecção à inscrição de um bem cultural através de carta dirigida ao Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura. Esta carta deve ser por ele recebida num prazo de quatro meses a contar do dia em que foi remetida cópia do pedido de inscrição.

    2. Tal objecção deve ser fundamentada. Podendo os únicos motivos válidos ser:

    a) Que o bem não é um bem cultural;

    b) Que as condições mencionadas no artigo 8.º da Convenção não se encontram preenchidas.

    3. O Director-Geral remete, sem demora, uma cópia da carta contendo a objecção às Altas Partes Contratantes. Pede, se necessário, a opinião do Comité Internacional para os Monumentos, Sítios Artísticos e Históricos e Escavações Arqueológicas e, para além disso, se o julgar útil, pede a opinião de qualquer outro organismo ou personalidade competente.

    4. O Director-Geral ou a Alta Parte Contratante que solicitou a inscrição pode tomar todas as diligências oportunas junto das Altas Partes Contratantes que formularam a objecção de modo que esta seja retirada.

    5. Se uma Alta Parte Contratante, após ter solicitado em tempo de paz a inscrição de um bem cultural no Registo, participar num conflito armado antes que a inscrição tenha sido efectuada, o bem cultural em causa será imediatamente inscrito no Registo pelo Director-Geral, a título provisório, até que seja confirmada, retirada ou anulada qualquer objecção que possa ter sido ou que poderia ter sido formulada.

    6. Se, num prazo de seis meses a partir da data de recepção da carta contendo a objecção, o Director-Geral não receber por parte da Alta Parte Contratante que formulou a objecção uma comunicação declarando que esta foi retirada, a Alta Parte Contratante que solicitou a inscrição pode recorrer ao procedimento de arbitragem previsto no número seguinte.

    7. O pedido de arbitragem deve ser formulado no mais tardar até um ano após a data em que o Director-Geral recebeu a carta contendo a objecção. Cada uma das Partes no litígio nomeia um árbitro. No caso de um pedido de inscrição ter sido objecto de mais de uma objecção, as Altas Partes Contratantes que formularam a objecção nomeiam, por mútuo acordo, um árbitro. Os dois árbitros escolhem um árbitro presidente da lista internacional prevista no artigo 1.º do presente Regulamento; se não conseguirem chegar a acordo de modo a efectuar esta escolha, solicitam ao Presidente do Tribunal Internacional de Justiça que nomeie um árbitro presidente que não necessita ser necessariamente escolhido da lista internacional. O tribunal arbitral assim constituído adopta o seu próprio regimento; não cabe recurso das suas decisões.

    8. Cada uma das Altas Partes Contratantes pode declarar, quando surgir um litígio do qual é Parte, que não deseja aplicar o procedimento de arbitragem previsto no número anterior. Neste caso, a objecção a um pedido de inscrição é submetida pelo Director-Geral às Altas Partes Contratantes. A objecção só será confirmada se as Altas Partes Contratantes assim o decidirem por uma maioria de dois terços das Altas Partes Contratantes votantes. O voto será feito por correspondência a menos que o Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura, julgando indispensável a convocação de uma reunião em virtude dos poderes que lhe são conferidos pelo artigo 27.º da Convenção, proceda a essa convocação. Se o Director-Geral decidir recorrer ao voto por correspondência, convidará as Altas Partes Contratantes a remeterem-lhe os seus votos mediante carta selada no prazo de seis meses a contar do dia em que o convite para esse efeito terá sido feito.

    Artigo 15.º

    Inscrição

    1. O Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura inscreve no Registo, sob um número de ordem, qualquer bem cultural em relação ao qual foi formulado um pedido de inscrição, desde que esse pedido não tenha sido objecto de uma objecção no prazo previsto no n.º 1 do artigo 14.º

    2. Nos casos em que tenha sido formulada uma objecção e, sem prejuízo do disposto no n.º 5 do artigo 14.º, o Director-Geral não inscreverá o bem no Registo a menos que a objecção tenha sido retirada ou se esta não tiver sido confirmada na sequência do procedimento referido no n.º 7 do artigo 14.º, ou do procedimento referido no n.º 8 do mesmo artigo.

    3. No caso referido no n.º 3 do artigo 11.º, o Director-Geral procede à inscrição a pedido do Comissário-Geral para os Bens Culturais.

    4. O Director-Geral remete, sem demora, ao Secretário-Geral da Organização das Nações Unidas, às Altas Partes Contratantes e, a pedido da Parte que solicitou a inscrição, a todos os outros Estados visados nos artigos 30.º e 32.º da Convenção uma cópia autenticada de qualquer inscrição no Registo. A inscrição produzirá efeitos 30 dias após este envio.

    Artigo 16.º

    Cancelamento

    1. O Director-Geral da Organização das Nações Unidas para a Educação, Ciência e Cultura cancela a inscrição de um bem cultural no Registo:

    a) A pedido da Alta Parte Contratante em cujo território o bem se encontra;

    b) Se a Alta Parte Contratante que solicitou a inscrição denunciou a Convenção, e a partir do momento em que essa denúncia produziu efeitos;

    c) No caso especial previsto no n.º 5 do artigo 14.º, quando uma objecção tenha sido confirmada na sequência dos procedimentos referidos quer no n.º 7 do artigo 14.º, quer no n.º 8 do mesmo artigo.

    2. O Director-Geral remete, sem demora, ao Secretário-Geral da Organização das Nações Unidas e a todos os Estados que receberam cópia da inscrição uma cópia autenticada de qualquer cancelamento no Registo. O cancelamento produz efeitos 30 dias após esse envio.

    CAPÍTULO III

    Dos transportes de bens culturais

    Artigo 17.º

    Procedimento para obtenção de imunidade

    1. O pedido referido no n.º 1 do artigo 12.º da Convenção é dirigido ao Comissário-Geral para os Bens Culturais. O pedido deve mencionar as razões que o motivam e especificar o número aproximado e a importância dos bens a transferir, a presente localização desses bens, a nova localização prevista, os meios de transporte, o trajecto a seguir, a data prevista para o transporte e qualquer outra informação útil.

    2. Se o Comissário-Geral, após pedir as opiniões que julga oportunas, considerar que essa transferência é justificada, consulta os delegados interessados das Potências Protectoras sobre as modalidades de execução previstas. Na sequência dessa consulta notifica as Partes no conflito interessadas sobre o transporte e anexa a essa notificação todas as informações úteis.

    3. O Comissário-Geral nomeia um ou mais inspectores que se asseguram que o transporte contém apenas os bens descritos no pedido e que o transporte é efectuado de acordo com as modalidades aprovadas e que é munido do sinal distintivo. O inspector ou inspectores acompanham os bens até ao seu destino.

    Artigo 18.º

    Transporte para o estrangeiro

    Se a transferência sob protecção especial se fizer para o território de outro país, esta rege-se não só pelo artigo 12.º da Convenção e pelo artigo 17.º do presente Regulamento mas também pelas seguintes disposições:

    a) Enquanto os bens culturais permanecerem no território de outro Estado, este Estado será o depositário desses bens e assegurará a esses bens os cuidados pelo menos equivalentes aos que tem para com os seus próprios bens culturais de importância comparável;

    b) O Estado depositário só restituirá esses bens após o fim do conflito; essa restituição terá lugar no prazo de seis meses após a formulação do pedido;

    c) Durante os transportes sucessivos e enquanto os bens culturais permanecerem no território de outro Estado, estes ficarão isentos de qualquer medida de embargo e quer o depositante quer o depositário não poderão dispor dos mesmos. Todavia, quando a salvaguarda dos bens o exigir, o depositário poderá, com o consentimento do depositante, fazer transportar os bens para o território de um terceiro país, nos termos das condições previstas no presente artigo;

    d) O pedido de colocação sob protecção especial deve referir que o Estado para cujo território o transporte será efectuado aceita as disposições do presente artigo.

    Artigo 19.º

    Território ocupado

    Sempre que uma Alta Parte Contratante que ocupa o território de outra Alta Parte Contratante transportar bens culturais para um refúgio situado noutro ponto desse território, sem poder seguir o procedimento previsto no artigo 17.º do Regulamento, o referido transporte não será considerado como um desvio nos termos do artigo 4.º da Convenção, desde que o Comissário-Geral para os Bens Culturais certifique por escrito, após ter consultado o pessoal normal de protecção, que as circunstâncias tornaram esse transporte necessário.

    CAPÍTULO IV

    Do sinal distintivo

    Artigo 20.º

    Afixação do sinal

    1. A colocação do sinal distintivo e o seu grau de visibilidade são deixados ao critério das autoridades competentes de cada Alta Parte Contratante. O sinal pode ser exibido em bandeiras ou faixas; pode ser pintado num objecto ou representado de qualquer outra maneira adequada.

    2. Contudo, sem prejuízo de uma sinalização eventualmente mais completa, o sinal deve, em caso de conflito armado e nos casos previstos nos artigos 12.º e 13.º da Convenção, ser afixado nos veículos de transporte de forma bem visível durante o dia, tanto do ar como da terra.

    O sinal distintivo deve ser bem visível de terra:

    a) A intervalos regulares suficientes para indicar claramente o perímetro de um centro monumental sob protecção especial;

    b) À entrada de outros bens culturais imóveis sob protecção especial.

    Artigo 21.º

    Identificação de pessoas

    1. As pessoas visadas o artigo 17.º da Convenção, n.º 2, alíneas b) e c), podem utilizar uma faixa munida do sinal distintivo, emitida e timbrada pelas autoridades competentes.

    2. Essas pessoas são portadoras de um cartão de identidade especial munido do sinal distintivo. Esse cartão refere, pelo menos, o apelido e os nomes próprios, a data de nascimento, o título ou categoria, e a função do titular. O cartão contém a fotografia do titular bem como a sua assinatura ou as suas impressões digitais, ou ambas. O cartão tem aposto o selo branco das autoridades competentes.

    3. Cada Alta Parte Contratante adopta o seu modelo de cartão de identidade inspirando-se, a título de exemplo, no modelo anexo ao presente Regulamento. As Altas Partes Contratantes transmitem entre si o modelo por elas adoptado. Cada cartão de identidade será, se possível, feito, pelo menos, em duplicado, ficando uma cópia com a Potência emitente.

    4. As pessoas supra mencionadas não podem ser privadas, sem motivo justificado, nem do seu cartão de identidade nem do direito de utilizar a sua faixa.
